If Citizenship and Immigration Canada (CIC) has refused your application to sponsor a close family member to Canada, you may appeal to the Immigration Appeal Division (IAD) of the Immigration and Refugee Board of Canada (IRB). The sponsor has 30 days after the refusal is received to appeal to the IAD.
The IAD may allow or dismiss a sponsorship appeal. The appeal may be allowed on:
- legal grounds; and/or
- A grant special relief on compassionate or humanitarian grounds.
If the IAD allows the appeal, the matter goes back for further processing and assessment of whether the requirements of the Immigration Act and Regulations are still being met.
The decision of the IAD may be judicially reviewed by either party to the Federal Court Trial Division with leave of the Court.
